Justification - facts and materials that serve as the basis for making a decision to file a claim in court or send a claim letter. Legal substantiation is a reference to normative legal acts regulating a specific legal relationship. Justification is facts and evidence on the basis of which circumstances relevant to the consideration of the case are established.
Instructions
Step 1
Identify the facts that need to be proven. The composition of the facts will depend on the legal status of the participant in the process, the presumptions established by law. The court may indicate the obligation to prove in the ruling.
Step 2
Explain the position on the case, that is, state the factual circumstances, the rationale. Provide evidence to support specific facts.
Step 3
The legal reasoning should be set out taking into account the legal force of the documents referred to. As a rule, references are first made to the Constitution of the Russian Federation, then to federal laws and by-laws. General rules governing specific legal relationships are determined by laws. The procedures are detailed in the bylaws. For example, in section VII of the Housing Code of the Russian Federation, the obligations of the owner and tenant to pay utility bills are enshrined. Directly the procedure for calculating and paying for utilities is spelled out in the "Rules for the provision of utilities to citizens", approved.
