Instructions

Step 1

Considering that in the Labor contract there is usually no concept of “unpaid leave”, and in the Labor Code of the Russian Federation in Chapter 19 “Vacation”, this concept is encountered, it is generally accepted that vacation at one's own expense is a type of social guarantee.

Step 2

According to Art. 128 of the Labor Code of the Russian Federation "for family reasons and other valid reasons, the employee, upon his written application, may be granted unpaid leave, the duration of which is determined by agreement between the employee and the employer."

Step 3

Thus, the granting of unpaid leave is of a declarative nature, that is, only at the request of the employee. None of the regulatory documents in any organization has such a vacation planned.

Step 4

It is necessary to write a statement addressed to the head of the organization.

In the "cap" we write the position of the head and his full name, as well as the position and full name of the applicant.

Step 5

In the center of the sheet, stepping back, write the word "Statement".

Next, we write: “I ask you to provide me with unpaid leave for ___ calendar days (here you must specify the number of days) from ____ _______ to ____ _______ 20__ (respectively, we indicate the dates).

Own leave is granted only if valid reasons or family circumstances are indicated. Usually it is enough to write “for family reasons”. Remember: the manager cannot require you to provide documents confirming the reason.

As indicated in the journal "Handbook of the personnel officer" No. 5, 2010 in the article "Vacation" at one's own expense ", “Unpaid leave does not include:

1) during the test period established upon hiring;

2) within one month from the date of discovery of a disciplinary offense, during which a disciplinary penalty can be applied;

3) within one month from the date of receipt of a reasoned opinion of the elected body of the primary trade union organization, during which the employer has the right to terminate the employment contract with the employee who is a member of the trade union;

4) in the calculated 12-month period when calculating the average wage in accordance with Art. 139 of the Labor Code of the Russian Federation;

5) in the insurance experience required for the appointment of retirement pensions”.

Step 12

Be aware that you cannot be fired while you are on unpaid leave, and no temporary disability benefit is awarded at your own expense while you are on vacation. That is, it will not be possible to go on vacation without pay and sick leave at the same time.
