During a financial crisis, for various reasons, downtime can occur at the enterprise. It should be documented in accordance with labor laws. Downtime must be paid to employees if it happened due to the fault of the employer or for reasons that do not depend on the employees of the organization and the employer.

Step 1

If downtime should be announced in a separate structural unit, then its head must write a memo addressed to the director. Its content should state the reasons that caused the downtime. The note must indicate the date from which it occurred. The director needs to consider the document and, in case of a positive decision, put a resolution on it, which should contain the date and signature of the first person of the company.

Step 2

Make an order in any form. In the header of the document, write the name of the organization in accordance with the charter or other constituent document or the surname, name, patronymic of an individual, if the enterprise's OPF is an individual entrepreneur. Write the title of the document in capital letters. Indicate the number and date of the order. The subject of the document should correspond to the announcement of downtime for the enterprise as a whole or for a separate structural unit. The reason for issuing an order may be short delivery of material, lack of orders, and others.

Step 3

In the content of the order, indicate the surnames, names, patronymics of employees for whom a simple period has been declared, the names of their positions, structural divisions. During downtime, employees cannot perform their labor function prescribed in the contract. If the downtime occurred due to the fault of the employer or for reasons beyond his control, then downtime days are paid to specialists in the amount of 2/3 of the salary, average salary (if it is announced, for example, due to the lack of applications from clients), in full (when the fault of the employer is present in the incident).

Step 4

Specify the start and end dates for the downtime. If it ends earlier or later than the date written in the order, then the director should issue a new order, in which to enter the actual date of its completion.

Step 5

If the downtime occurred through the fault of the employee, then this period is not paid to him, but an administrative penalty in the form of a fine is collected.

Step 6

During downtime, the employee cannot perform his job duties, therefore the employer has the right to allow employees not to be present during the downtime at the workplace. This fact should be indicated in the order.

Step 7

Certify the order with the seal of the company, signed by the director of the organization. Familiarize employees with the document. Employees should be personally signed and dated.
