It often happens that the seller does not issue a receipt to the buyer. And on the market, a check is out of the question. So what to do if it turns out that the purchased item is defective? It can be exchanged.
Instructions
Step 1
First of all, you need to collect all possible facts that will help you prove that the product was actually purchased from a specific seller. These facts may be the testimony of witnesses; a tag attached to the product with a serial number; consumer packaging, as well as any other confirmations.
Step 2
After collecting evidence, you can safely go to the seller. If the seller refuses to exchange a defective product, then you just have to make a written claim. In it, describe the entire situation that has developed, as well as attach all the evidence you have. Be very careful when filing a complaint. Indeed, to a greater extent, the outcome of the case depends on how it will be written. It is recommended that you write a short but clear and harsh claim. Don't write "I'm asking." Instead, write "I demand."
In addition, the claim must be made in duplicate. Leave one copy with the seller, and take the second for yourself. Moreover, the seller must sign on your copy, put a seal and make an appropriate note that the claim has been accepted.
Step 3
If the seller does not want to accept your claim, go to the store or market administrator. If they begin to accuse you that you yourself have improperly exploited the thing, then you need to insist that an examination be carried out. In addition, you have every right to attend it. Therefore, in your claim, write about what you want to know about the time and place of its holding. Justify your desire with the Law "On Protection of Consumer Rights". It is also worth noting that you do not have to pay for the examination, it is carried out at the expense of the seller.
Step 4
If the examination decides that you are to blame, then you will have to pay the seller the cost of its implementation. But if the seller is to blame, then he is obliged to satisfy your requirements within seven days.
