According to article 255 of the Labor Code of the Russian Federation, employers are required to provide pregnant women with leave, while managers must calculate maternity benefits. According to the new rules, the calculation of maternity payments is carried out for the last 24 months of work. But at the request of the expectant mother, the allowance can also be calculated according to the old rules, that is, for the last year of work.
First of all, it should be noted that maternity leave is granted on the basis of a sick leave issued by a medical institution. This document must indicate the date of the vacation, enter the data of the expectant mother (including the place of work and position), be signed by the head physician and the seal of the hospital. A woman carrying one child is entitled to a vacation of 140 days (70 - before childbirth, 70 - after); with multiple pregnancies, this number increases to 194 days (84 - before delivery, 110 - after them). If the birth was difficult, the mother's maternity leave is increased by 16 days. To do this, the woman needs to provide a certificate from the maternity hospital. Calculation of maternity benefits according to the old rules According to Federal Law No. 255 (old version), maternity benefits are calculated based on the average earnings for the twelve months preceding the month in which a woman goes on vacation. For example, according to the sick leave, the employee must go on maternity leave on February 1, 2012. The period from February 1, 2011 to January 31, 2012 is taken into account. First of all, you need to calculate the average earnings for the year. Add up all payments minus those that were paid in connection with temporary disability, vacation, downtime, financial assistance. Divide the received amount by 365 days. Then multiply this number by the number of vacation days, and you get the amount of maternity payments. There is a maximum amount that a woman can receive for maternity leave, it is 1402.74 rubles / day, that is, for 140 days of vacation, the allowance will be 196386.3 rubles. Calculation of maternity benefits under the new rules In accordance with the new version of the federal law, maternity benefits can be calculated based on the average earnings over the past two years. The calculation algorithm is the same as under the old rules, but everything is calculated in 24 months, that is, the amount of payments is divided not by 365 days, but by 730. The maximum amount of payments is 1202.74 rubles / day, that is, 168383.6 rubles per 140 days. Important: in case of difficult childbirth, the period of maternity leave is increased by 16 days. Accordingly, maternity payments are also increasing. To charge additional payments, a woman must provide a certificate from the maternity hospital, write an application for recalculation. The amount is calculated in a similar way, that is, the average earnings are calculated, the amount received is multiplied by 16. Maternity benefits are not the only type of benefit that you are entitled to. For example, if you have given birth to your second child, you must receive maternity capital. In addition, you are entitled to a one-time childbirth allowance.
