Regular vacation is guaranteed rest days, which must be provided annually in an amount of at least 28 calendar days (Chapter 19 of the Labor Code of the Russian Federation). Any employee can use vacation in parts, but one part of it must be at least 14 calendar days (part 1 of article 125 of the Labor Code of the Russian Federation).

Instructions

Step 1

To receive vacation in parts, you should agree on this decision with the head of the company before scheduling vacation. The schedule is drawn up in December or maximum in January after the New Year holidays.

Step 2

It is necessary to draw up a bilateral agreement between the employee and the employer on the use of the second part of the vacation in installments. In accordance with the law, the employee has the right to use the remaining vacation days at least one day a week, but before taking one or more of the remaining days, the employer must be notified in writing at least three days before the actual days of rest.

Step 3

The 14 days of vacation specified in the law as one indivisible part are distributed and provided in accordance with the vacation schedule drawn up at the enterprise. Each employee is introduced to the schedule on receipt (article 123 of the Labor Code of the Russian Federation).

Step 4

You can go on vacation outside the schedule at any time convenient for you: minor employees, pregnant women before maternity leave or at the end of parental leave up to one and a half or three years, husbands whose wives are on maternity leave, spouses of military personnel, if the husband or wife is on vacation. Labor legislation did not provide for such a benefit for other categories of employees.

Step 5

For example, the leave of minors is 31 calendar days (Article 267 of the Labor Code of the Russian Federation). 14 days is an indivisible vacation, 17 days is that part of the vacation that can be divided into 1, 2 or several parts. If desired, the employee has the right to take all 17 days, one day at a time, throughout the year. The vacation of the disabled cannot be less than 30 days (Article 23-FZ and 183 of the Labor Code of the Russian Federation), 14 is an indivisible part, 16 is a divisible part. In the same way, you can calculate the vacation of any category of employees.

Step 6

If an employee is supposed to provide additional vacation days, for example, for work in difficult, harmful and dangerous conditions, then these days are added to the next annual vacation and are divided into any number of days, but one part of the rest must be at least 14 calendar days.
