Step 1

The simplest option is to follow the terms of a fixed-term employment contract until the end of its validity. In this case, the employee will work until the date specified in the document. Upon its occurrence, in accordance with Article 58 of the Labor Agreement of the Russian Federation, the agreement will lose its legal force, after which it is possible to conclude a new fixed-term labor agreement with the employee, if necessary.

Step 2

Extend a fixed-term employment contract with an employee until its expiration, for example, if in the future you will not be able to immediately conclude a new contract. Be guided by the 72nd article of the Labor Code of the Russian Federation, according to which the employer and the employee are required to conclude an agreement on amendments to the employment contract in writing. In the presence of the employee himself, draw up this document, indicating all the provisions of the agreement that will be changed. If you need to extend only its term, in fact, there will be only one change. The agreement must be certified with the signatures of the employer, employee and the seal of the organization. After that, you can draw up a new fixed-term employment contract, which will immediately enter into force.

Consider some provisions of the Labor Code of the Russian Federation that regulate the conclusion of a fixed-term employment contract. For example, Article 58 states that a fixed-term employment relationship cannot last more than five years. At the same time, it is prohibited to conclude an open-ended contract with an employee by disguising it as an extension of a fixed-term contract. This restricts the rights and freedoms of the employee and provides for the imposition of administrative sanctions on the employer.
