When applying for a job, it is important to know what documents are required for the correct registration of a future employee. The main list is clearly spelled out in the Labor Code, all other documents are prohibited to require. An extended list of documents may be required when hiring state and municipal employees, which is spelled out in the relevant decrees and regulations.
Everyone applying for work must have:
- passport, as well as other identity documents. Such documents can be a foreign passport (if a foreign worker is issued) or a refugee certificate;
- work book, except for those entering work for the first time, as well as part-time workers (including an extract from the work book in electronic form);
- a document confirming registration in the individual (personal) accounting system, including in the form of electronic document management. It can be a SNILS card, or an electronic document in the form of ADI-REG;
- documents of military registration: registration certificate for conscripts and military ID for conscripts;
- a document on education and (or) qualifications, or the presence of special knowledge (when applying for a job requiring special knowledge or special training). Such documents can be a certificate of secondary education, a diploma of secondary vocational or secondary special, as well as higher education, diplomas of professional retraining and advanced training. If a different surname is indicated in the education document, then a marriage certificate or a document on name change is additionally attached;
In certain areas of organization, the following documents are required:
-certificate on the presence or absence of a criminal record (or) the fact of criminal prosecution or on the termination of criminal prosecution on rehabilitating grounds (if, according to the law, such persons are not allowed to this field of activity). The presence of such a certificate is prescribed in the Order of the Ministry of Internal Affairs No. 1121 dated 07.11.11;
- a certificate containing information that the person was not subjected to administrative punishment for the consumption of narcotic and psychotropic substances without a doctor's prescription (if such a certificate is required by law for this type of activity). Information about this certificate can be found in the Order of the Ministry of Internal Affairs No. 665 dated 24.10.16.
What if the employee does not have all the documents available?
According to the law, it is impossible to refuse a job due to the lack of a work book and military ID.
If the work book is missing, including in the form of an electronic statement), then the employee must make a request for a duplicate at the last place of work. If the future employee is unable or unwilling to do this, a new work book is drawn up without previous entries on his letterhead.
In the absence of a military card (for those liable for military service), it is necessary to explain to the citizen his obligation to appear at the military registration and enlistment office at the place of residence or place of temporary registration to receive a military registration document, and also be sure to receive a receipt from him that the procedure for applying to him has been explained. If an employee has evaded military service, then he must have a certificate in his hands instead of a military ID. If a military ID is being reissued, a temporary certificate is provided to confirm this fact.
When registering a citizen liable for military service without a military ID, it is imperative to send information to the military registration and enlistment office at the place of residence or temporary registration that you are hiring this citizen and the information that he must appear at the military registration and enlistment office has been explained to him.
What else should be taken into account when processing documents?
When registering an employee for work, you should also check the need for a referral for a preliminary medical examination (according to the order of the Ministry of Health and Social Development of Russia No. 302N dated 2011-12-04). The employer pays for the preliminary medical examination. After receiving a referral for a medical examination, the future employee must go through it before concluding an employment contract.
