Subjects of different market segments, in order to carry out activities that fall under self-regulation, need to be members of an SRO (self-regulatory organization). The purpose of such an association is to supervise and control the activities of industry enterprises.

Non-profit partnerships and professional associations that perform the functions of a regulator in some areas of the domestic economy replaced state licensing more than a decade ago. The basic normative document for the institute of self-regulation is Federal Law No. 315, adopted on 01.12.2007.

Areas of industry regulation

The norms of the Federal Law No. 315 determine that participation in an SRO is either mandatory or voluntary (depending on the type of activity performed). At the same time, an enterprise or an entrepreneur can be a member of only one profile self-regulatory association.

Participation in SROs on a voluntary basis is carried out in such areas as advertising, mediation, registration of patents. On their own initiative, industry non-profit partnerships and associations unite manufacturers of building materials, agricultural products, sports equipment, elevators, garbage recyclers, property managers, doctors, manufacturers of many goods and even eventors. There are 425 operating SROs in Russia, the creation of which was initiated not by the legislator, but by the subjects of the services market.

For the overwhelming majority of representatives of various segments of the economy, membership in an SRO is mandatory, giving the right to enter the service market only if they meet the professional requirements imposed on them. These include 552 non-profit partnerships. According to the chronology of legislative consolidation of the requirement for mandatory participation in SRO, industry associations were created in the following areas:

  • cadastral engineers;
  • appraisers;
  • arbitration managers;
  • auditors;
  • credit cooperatives;
  • revision unions;
  • agricultural cooperatives;
  • designers, surveyors, builders;
  • specialists in the field of energy and heat supply;
  • organizers of gambling;
  • financial market participants.

In all spheres of professional activity, where self-regulation mechanisms are applied, a record is kept of organizations that have received the powers of a self-regulator, acting SROs and have lost this status. The executive bodies of state power are authorized to maintain the Unified State Registers of Self-Regulatory Organizations (USR SRO).

The largest number of SROs belongs to the construction sector, where the “three pillars” of the construction complex operate. Sectoral regulatory structures of designers, surveyors and builders control the process at all stages, take on collective responsibility for the quality and safety level of the work performed. Also, regulators represent the interests of their members in relations with state structures and municipal authorities. An up-to-date list of operating SROs is given on the portal of the Federal Service for Environmental, Technological and Nuclear Supervision www.sro.gosnadzor.ru.

Among the first in the field of architectural and construction design, the Interregional Association of Architects and Designers www.npmaap.ru was created. The rating score of the RASK class B3, given in the characteristics of the self-regulator with the registration number SRO-P-083-14122009 on the website www.all-sro.ru/register/srop/083-np-maap, testifies to the stability and reliability of the MAAP.

The large association "National Association of Builders" NOSTROY unites half of the total number of companies engaged in housing, civil and industrial construction.

The partnership of persons conducting design and survey work NOPRIZ unites 171 design and 40 engineering and survey SROs.

In the professional market of arbitration managers, reputable and well-established participants are RNO PAU (www.rsopau.ru), MCO PAU (www.npmsopau.ru) and Avangard (www.oau.ru).

In the state register of SRO of auditors - associations "Russian Union of Auditors" and "Sodruzhestvo". Detailed information about their activities, the code of honor of auditors and professional standards are given on the portal of the Ministry of Finance of the Russian Federation www.rar.gov.ru/registry/sroregistry.

The unified state register of self-regulating organizations of appraisers is published on the website "Appraiser.ru" www.ocenchik.ru/orgs. The information resource is intended for consumers of services and specialists in the assessment of all forms of ownership. The site has a large consulting base, including various forms of interactive, a calculator of physical wear and tear, as well as an online appraisal of an apartment, car, etc.

The Bank of Russia exercises state control and supervision over microfinance organizations included in the state register: www.cbr.ru/finmarket/supervision/sv_micro. The absence of MFOs in the database of the Central Bank of the Russian Federation means that the activities of this company are not regulated by the Bank of Russia and does not obey its rules, which means that loans here can be issued on inadequate terms. Comparative data on participants in this segment of the financial market and credit conditions can be found on resources such as www. zaim.com/reestr-mfo, www.moskva.vbr.ru/mfo, etc.

Features of Moscow SROs

According to statistics, SROs have more than 234 thousand members in various spheres of the domestic economy. About 40% of the total number of operating sectoral self-regulators are registered in Moscow.

Such leadership of the capital is quite understandable and justified. Here, normative acts are created and discussed at the legislative level, advanced work standards and innovative approaches are applied, industry congresses and conferences are held. Of course, this motivates representatives of the regions to join the Moscow SROs. Members of the capital's professional associations can count on receiving the necessary legal support, using consulting services and the help of highly qualified specialists.

SROs in Moscow have solid compensation funds that can guarantee their members a "safety cushion", can provide installments for payment of contributions, etc. The creation of interactive sites, operational electronic document management, and a well-functioning mechanism for advanced training also attract enterprises from the periphery to become members of non-profit associations of federal significance.

A distinctive feature of the work of Moscow SROs is the transparency of financial and economic activities and high business activity. Promoting and lobbying the interests of the industry as a whole, they unite in large industry associations (NOSTROY, Unity, RSOPAU, etc.). Member companies of the united non-profit partnerships have the opportunity not only to develop effectively, but also to have a real impact on improving the quality of professional services provided.

SRO information resources

According to experts, more than a third of SROs do not have their own website, are not represented on the Internet in any other legal way. Therefore, monitoring of self-regulatory organizations is of great importance.

On the site, you can consult with specialists from specialized non-profit partnerships, draw up and send an application for obtaining SRO permits online.

One of the tools to combat the excessive commercialization of SROs is the rating system. The rating agency of the building complex RASK (www.rask.ru) makes rankings of regulators among builders, designers and surveyors, gives objective characteristics, and also assesses the degree of their reliability. Rostechnadzor is implementing a program to identify unscrupulous commercial regulators, the results of which are published in open sources.

The information posted is based on data obtained from official sources of the executive authorities authorized to maintain the USR of the SRO (Rostekhnadzor, Rosreestr, the Ministry of Finance, the Ministry of Energy, the Central Bank, etc.), as well as information published on the official websites of Moscow self-regulators and regional SROs.
