Subjects of different market segments, in order to carry out activities that fall under self-regulation, need to be members of an SRO (self-regulatory organization). The purpose of such an association is to supervise and control the activities of industry enterprises.
Non-profit partnerships and professional associations that perform the functions of a regulator in some areas of the domestic economy replaced state licensing more than a decade ago. The basic normative document for the institute of self-regulation is Federal Law No. 315, adopted on 01.12.2007.
Areas of industry regulation
The norms of the Federal Law No. 315 determine that participation in an SRO is either mandatory or voluntary (depending on the type of activity performed). At the same time, an enterprise or an entrepreneur can be a member of only one profile self-regulatory association.
Participation in SROs on a voluntary basis is carried out in such areas as advertising, mediation, registration of patents. For the overwhelming majority of representatives of various segments of the economy, membership in an SRO is mandatory, giving the right to enter the service market only if they meet the professional requirements imposed on them. According to the chronology of legislative consolidation of the requirement for mandatory participation in SRO, industry associations were created in the following areas:
- cadastral engineers;
- appraisers;
- arbitration managers;
- auditors;
- credit cooperatives;
- revision unions;
- agricultural cooperatives;
- designers, surveyors, builders;
- specialists in the field of energy and heat supply;
- organizers of gambling;
- financial market participants.
In all spheres of professional activity, where self-regulation mechanisms are applied, a record is kept of organizations that have received the powers of a self-regulator, acting SROs and have lost this status. The executive bodies of state power are authorized to maintain the Unified State Registers of Self-Regulatory Organizations (USR SRO).
The largest number of SROs belongs to the construction sector, where the “three pillars” of the construction complex operate. Sectoral regulatory structures of designers, surveyors and builders control the process at all stages, take on collective responsibility for the quality and safety level of the work performed. Also, regulators represent the interests of their members in relations with state structures and municipal authorities.
