By the way, the presence of children under the age of 18 does not require the establishment of the fact of their dependence, with the exception of special cases when children can be recognized as capable. The time of the onset of incapacity for work (for people with disabilities) - before or after the death of the person with whom they were dependent, does not affect their right to compensation for harm.

Step 3

Collect documents to establish whether you received ongoing assistance from the deceased person. The court will take into consideration these documents only if it is proved that she was your only source of existence. To do this, you will also need to submit certificates of salary, pension, scholarships, and the court, having identified their relationship with the amount of assistance that was provided to you, will make a decision.

Step 4

Submit to the court other evidence that you were dependent on the deceased person, namely: - a certificate from the place of residence (from the housing office) that you applied for certificates of being dependent and / or about the composition of the family, an extract from the house books; - documents confirming your disability or incapacity for work of your family members; - evidence of the fact that you received permanent assistance (testimony of witnesses, receipts of postal and bank transfer certificates, personal correspondence, rental agreement, etc.); - evidence of family relations (certified copies certificates of marriage, birth, etc.).
