Unscrupulous sellers often, seeing the legal illiteracy of the consumer, refuse to comply with legal claims for damages. Therefore, a correctly drawn up claim with a competent statement of your requirements will significantly help you in protecting your interests. And for this, carefully study the articles of the Law of the Russian Federation "On Protection of Consumer Rights" and other legislative and regulatory acts on this issue.
Instructions
Step 1
Please note that you can submit an application (claim) only in relation to the goods, the defects of which the seller did not warn you about at the time of purchase.
Step 2
Decide what kind of requirement you are going to put forward to the seller, since several requirements cannot be put forward in the application at once.
You are entitled to:
• gratuitous elimination of product defects;
• a commensurate decrease in the purchase price;
• replacement of goods with exactly the same, but of high quality (of the same brand, article, etc.);
• replacement of a product for a similar product of a different brand with a recalculation of the price;
• termination of the sale and purchase agreement with reimbursement of funds.
Step 3
When writing an application, indicate to whom you are sending a claim, i.e. the name of the selling organization, the position of the head, his full name (if you know them). And also do not forget to indicate your full name and contact information.
Step 4
State the facts of the case in the text of the claim. Be specific and concise about your circumstances. Write the date when the purchase was made, mention the presence of a cash register (sales receipt) and a warranty card. Emphasize that the warranty period has not yet expired, and that you have strictly followed all the requirements for using the product.
Step 5
In the text of the application, refer to the relevant articles of laws, the requirements of GOSTs and other regulatory documents. You can find a complete list of these documents on the website of the Society for the Protection of Consumer Rights, as well as read samples of writing claims, on the basis of which you can competently draw up your own.
Step 6
Attach to the application: a copy of the sales or cash receipt, a copy of the warranty card, copies of acts, certificates and other documents that you have in connection with your claim.
Step 7
Make a copy of this claim. Give the original to the seller and keep a copy for yourself. At the same time, demand that the employees of the selling organization sign on your copy of the receipt of the claim. If the seller refuses to accept the claim, send it by regular mail in a letter with a declared value with a list of attachments and a receipt acknowledgment.
