Actions of a non-resident in the event of an expired migration card
If a foreign citizen (or a stateless person) has an expired migration card, it is necessary to take measures to prevent problems with Russian law enforcement agencies when leaving the country or in cases of requesting documents confirming the identity and the right to stay on the territory of the Russian Federation. To do this, you must voluntarily contact the department of the Federal Migration Service and go through the following procedures:
- drawing up a protocol on an expired migration card, - execution of a resolution on bringing a person to administrative responsibility, - payment of the fine specified in the decree.
Further, when leaving the territory of the Russian Federation, a foreign citizen must present a copy of the protocol and resolution, as well as the original receipt of payment of the fine, to the border service officers.
Legislative rationale and penalties
By means of a migration card, the bodies of the federal migration service carry out mandatory control over all entering foreign citizens. Violation of the terms of stay in the country is reflected in the expired migration card, is a violation of the rules of stay in the territory of the Russian Federation and carries administrative responsibility. In accordance with paragraph 1 of Art. 18.8 Chapter 18 of the Code of Administrative Offenses of the Russian Federation, such a violation is punishable by a fine in the amount of 2 to 5 thousand rubles, as well as expulsion from the Russian Federation or without it.
The amount of the fine is determined depending on the region, circumstances and the presence of similar violations in the past. In the event of a repeated violation, the amount of the fine is from 5 to 7 thousand rubles.
If the migration card is expired for the first time, the administrative expulsion of a foreign citizen is carried out in the form of a voluntary, independently controlled departure to the territory of Russia. In the event of a repeated violation, the expulsion of a person from the territory of the country is carried out forcibly with the involvement of law enforcement officers.
In addition, in accordance with Art. 26.8 Chapter 26 of the Federal Law on the procedure for leaving the Russian Federation and entering the Russian Federation (Federal Law No. 114), in case of failure to leave the Russian Federation within 30 days after the expiration date of the migration card, a ban on subsequent entry is envisaged for the next 3 years.
