Instructions

Step 1

After the plaintiff submits an application to the judicial authorities for the recovery of alimony from the defendant, the court makes a decision and determines their amount. If the defendant has a stable income, the amount of alimony in accordance with the Family Code of the Russian Federation is established as a percentage of all his income: 25% for 1 child, 30% for 2 children and 50% for 3 or more children. If the defendant does not have a job and a permanent income, then the amount of alimony is set in a fixed amount of money, which depends on the defendant's presence or absence of other minor children, his state of health and other equally important reasons.

Step 2

To increase the amount of alimony for the maintenance of a minor child, the plaintiff must apply to the judicial authorities with a corresponding statement, which must indicate the reasons that prompted him to take this action. For example, in the case of receiving information about the defendant's additional income, which he is hiding. In this case, the judicial authorities should be engaged in the search for evidence.

Step 3

In addition, the plaintiff has the right to apply for an increase in alimony if the child has serious health problems that require expensive treatment. In this case, the defendant may be awarded, pay up to 50% of the amount spent on medical services.

Step 4

In the event that the defendant has a low income and the amount of alimony is not sufficient for the normal maintenance of the child, the court may increase the amount of alimony. In this case, the material capabilities of the defendant in this case do not matter.
