In 1992, the law on the possibility of terminating labor relations at the initiative of the employer with an employee who has reached retirement age became invalid. Currently, dismissal in connection with retirement is possible either at the employee's own request, or on a general basis, on an equal basis with other employees, in accordance with the relevant articles of the Labor Code of the Russian Federation.

Instructions

Step 1

Get the employee's letter of resignation. Please note that if the letter contains the wording “I ask to fire me in connection with retirement,” the employer does not have the right to demand so-called work for two weeks, but is obliged to dismiss the future pensioner within the time period specified in the application.

Step 2

Prepare a draft order, according to the written statement on the approved T-8 form. In the order, give the position, surname and initials of the employee, the date of dismissal, the reason, the article of the Labor Code. Give explanations to the accounting department about making the necessary payments:

- salary for actually worked time;

- compensation for unused vacation;

- incentives in the form of monetary remuneration (if provided for by local acts, collective agreement or requirements of the trade union committee).

Step 3

If necessary, draw up an act of acceptance and transfer of cases and material values.

Step 4

After the approval of the order of dismissal by the head of the organization or his authorized representative, prepare a package of documents necessary for issuance to the future retiree. Fill in the record in the work record book “I was dismissed of my own free will in connection with retirement. Article 77, part one, paragraph three of the Labor Code of the Russian Federation”, put the date of dismissal and the number of the order. Fill in the appropriate fields in the personal card of the employee T-2, in the book of dismissal, in the Journal of the movement of work books.

Step 5

On the last working day, familiarize the employee with the text of the dismissal order and with the entry in the work book. Hand out a work book and copies of personalized accounting information against signature in the corresponding journals.
