Step 1

In accordance with the Labor Agreement of the Russian Federation, an employee can demand an extension of a fixed-term contract from the employer. Let's say you, while working on a temporary contract, found out about your pregnancy. Write a statement addressed to the head of the company. It may be as follows: “I ask to extend the term of a fixed-term employment contract from (date) No. _ until the end of pregnancy. Reason: medical certificate dated (date) No._ . Attach a document confirming your pregnancy to the application. The medical certificate must be drawn up correctly, have all the necessary stamps and signatures.

You can also conclude an additional agreement with the employer. In it, indicate the new term of the employment contract (it should not exceed five years). Do not under any circumstances write the wording that implies the extension of the term. Better to label this fact as a change in the expiration date of a legal document. If you are transferred to another position, for example, in the case of the main employee leaving for work, this should also be spelled out in the supplementary agreement. Be sure to include the effective date of the document.

Please note that if the head of the organization wants to change the terms of the contract, including the deadline, he must notify you about this no later than three days before the new terms come into force. If he did not inform you about this, you can continue to work on a permanent basis.

According to the Labor Code, it is impossible to extend the term of a fixed-term contract, therefore it is more correct in this case to use the wording “change of the term”. If the employer wants to continue working with the employee on a permanent basis, it is advisable to terminate the fixed-term employment contract and conclude a new one for an indefinite period. But in this case, you must be paid compensation for the unused vacation days.
