According to the Labor Code, every person working under an employment contract is entitled to annual paid leave for 28 calendar days. As a rule, this number can be increased, for example, in the case of work in the Far North or areas close to it, as well as when working with harmful and dangerous working conditions. The length of the leave depends on the length of service. How do you calculate it?

Step 1

First, it should be said that the employee's right to vacation arises after 6 months from the date of employment. But if you are a minor, a veteran, the wife or husband of a military serviceman, then the leave is provided in advance, regardless of the days worked.

Step 2

When calculating seniority, the days of actual stay at work, days spent on sick leave, days of forced absenteeism (in case of illegal suspension from work) should be included. This does not take into account parental leave, truancy and unpaid leave (if it was more than 14 days).

Step 3

In order to calculate the duration of the vacation, find out the number of calendar days of vacation for a month, for example, if, according to the law, you have the right to count on 28 calendar days of vacation per year, then for a month you are entitled to 2, 33 (28 days / 12 months), in case 36 days - 3 days for each month, etc.

Step 4

Then add up all the days of work minus those described above. Then multiply the resulting number by 2.33 (in the case of a 28-day vacation).

Step 5

It should also be borne in mind that if an employee has worked less than 15 days in a month, then the number is rounded down, and vice versa. For example, engineer Ivanov V. V. for 2010 worked 8 months and 18 days. Thus, when calculating vacation, 9 months are taken, that is, 2, 33 days (for each month) * 9 = 21 days of vacation

According to the Labor Code, an employee who works part-time (minors, pregnant women and other categories) also has the right to leave, and part-time is taken as a unit.

If the vacation period includes holidays, for example, New Year's holidays, then their number is added to the vacation, that is, they are not included in the number of rest days.
