Step 1

You have the right to receive an inheritance in two cases: by a will drawn up by the deceased, or by law. Close relatives usually have legal grounds. Therefore, in the case when there are two or more heirs, the property is distributed according to a court decision.

Step 2

There are several types of claims to the inheritance court. It can be statements about the rejection of the inheritance, about the inclusion of property in the inheritance, about the establishment of the fact of inheritance and heirs. The main thing is to indicate the correct name of the application so that the document is already in the “right hands” in the judicial authority.

Step 3

The name of the application is written in the middle after the introduction, i.e. "Hats". The very same "cap" is usually placed in the upper right (or left) corner. Write your application in A4 format with a pen (blue or black), or type on a computer - both are acceptable.

Step 4

Write in the introductory block in order: the name of the judicial authority you are applying to, general information about the plaintiff, representative (if any) and the defendant. The concept of general information includes such data as surname, first name, patronymic, actual address, valid telephone and fax numbers.

Step 5

The content of the main body of the statement is divided into two parts. In the first, you describe in detail and competently the situation related to the inheritance, and in the second, you clearly state your requirements in relation to the plaintiff and the court.

Step 6

Describing the current situation, do not forget that your statement of claim on the inheritance must contain evidence of the fact of the very discovery of this inheritance (death certificate) and your rights to receive it (will, or documents confirming the relationship with the deceased). Attach other documents and their copies, including a copy of the application itself. Sign and certify the document with a notary.
