Step 1
Article 131 of the Code of Civil Procedure of the Russian Federation, which establishes the form and content of the statement of claim, does not indicate any special forms for statements of claim. The statement of claim can be typed or handwritten. But it is worthwhile to understand that a well-written statement of claim will significantly reduce the time and the result of litigation.
Step 2
In the first part of the statement of claim, you must indicate:
1. The name of the court to which you are applying;
2. Your (ie the plaintiff's) surname, name, patronymic and place of residence. If the applicant is a company, its name and location. The same is indicated if the application is submitted by a representative;
3. The same data of the defendant;
4. If third parties appear in the case, for example, witnesses, then we indicate their data too.
Step 3
In the second part, you need to clearly and clearly state the very fact of the current situation that violates your legal rights. Describe everything in as much detail as possible, but without further ado, so as not to confuse the court with unnecessary statements. It will be very good if, when describing your situation, you provide links to the relevant regulations.
Step 4
In the third part of the statement of claim, indicate your requirements for the defendant and petitions. It will also be nice if you substantiate your requirements with relevant laws and other regulations.
Step 5
And in the last part of the application, the documents that you attached to carry out the process are described, proving the circumstances you described. Copies of documents are attached in an amount equal to the persons involved in the case. Also attached to the application is a document confirming the payment of the state duty.
Necessarily, the date and signature of the plaintiff are put at the end of the statement of claim.
