Do you have disagreements with management and the likelihood of an “unplanned” dismissal at your job? Try to get out of this situation by minimizing losses as much as possible. A competently drawn up complaint against the employer will help to defend the rights of the employee.
Instructions
Step 1
In order to protect your rights, which violates your employer, first contact the labor inspectorate, whose main function is to monitor labor laws. There is such an inspection in every city.
Step 2
State your grievances in writing. Try not to get carried away, write short, to the point and without emotion. It is very difficult to read long messages, until you reach the end, you forget what happened in the beginning. Do not occupy more than one or two pieces of paper (A4 size) with a written complaint.
Step 3
In order to correctly formulate your claims, indicate what specifically violated the rights, and then try to indicate how, in your opinion, it is possible to correct this situation.
Step 4
List reasonably those facts of violations by the employer of your rights, on which it is possible to provide evidence, i.e. confirmed by documentary evidence, or by witness testimony. And the more they are indicated, the more effective the complaint will be.
Step 5
Draw up a so-called attachment list and add it to the end of your written complaint. In the text of the complaint, make references to the documents you have. The scope of such applications is not limited, it all depends on your ability to collect the evidence base.
Step 6
Be sure to ask for a written response to your application in the text of the complaint and indicate the address of the recipient of the response.
Step 7
What if the complaint against the employer to the labor inspectorate did not have the expected result? Then you need to contact the prosecutor's office. In this case, you must also state your claims in writing, however, subject to the following rules.
Step 8
Correctly fill out the "heading" of the application - in the upper right corner of the sheet of paper indicate to which prosecutor you are sending the application (preferably the address of the prosecutor's office) and his position, while the name of the prosecutor is not necessary to indicate. The application should be sent to the prosecutor's office, which is geographically located in the area where your employer is located.
Step 9
You can express the essence of the question in any form, but briefly and clearly. Indicate in the complaint: who you are, the date of employment, the date of dismissal (if any), how the employer violates your rights by law, then state your requirements (for example, "please take action to …")
Step 10
In addition to your coordinates, please provide the coordinates of your company, indicating the names of managers, addresses and telephones. Discard all sorts of personal stories, only specifics. Sign and date at the end of the application.
