In everyday life, each of us has to act as consumers. We buy various goods in stores or order certain services for ourselves. But, unfortunately, consumer rights are not always respected. And what about consumer protection, for example, in Ukraine?
Who is covered by consumer protection law?
The Law of Ukraine "On Protection of Consumer Rights" adopted in 1991 establishes clear rules of the game between buyers and sellers (producers) regarding the purchase of goods, works and services. This law applies to trade enterprises and citizens who buy something to meet their personal needs. Consumer protection law does not apply to legal entities acting as buyers.
What consumer rights are protected by law
The law protects the rights of consumers when they purchase goods, works and services. These rights relate not only to the quality of the product, but also to its safety, the availability of complete and reliable information about it. So, the law spelled out what to do in the event that a product of inadequate quality was sold or for some reason (color, size, etc.) did not suit the buyer. Similarly, the rights of consumers are enshrined in the event that they receive work or services.
Defines the law and the rights of buyers in the field of trade and consumer services. However, here the consumer must additionally be guided by the rules of trade in certain types of goods, which are approved by the Cabinet of Ministers and other state bodies of Ukraine. So, currently there are rules for trade in food and non-food products, alcoholic beverages, tobacco products, etc.
Considerable attention is paid in the law to the realization by consumers of their rights within the framework of certain types of trade. For example, a separate article of the law is devoted to the rights and obligations of lenders and borrowers in the case of purchasing goods on the terms of a consumer loan. Also, the law spelled out the rights of consumers in the case of purchasing goods outside retail premises.
Established by law and responsibility for certain violations in the field of consumer protection. For example, penalties can be applied for the absence of price tags for the goods, for refusal to issue a check or exchange of low-quality goods.
Where to complain to the consumer in case of violation of his rights
In Ukraine, there is a special state body that deals with the protection of consumer rights. These are the State Inspectorate for the Protection of Consumer Rights and its territorial bodies. Its competence includes monitoring compliance with legislation in the field of consumer protection. Any buyer, in case of violation of his rights, can apply there with a written complaint. And then the trade enterprise should wait for verification and the imposition of significant penalties.
