Forensic medical examination - a procedural action consisting of a medical expert conducting special research on biomedical issues arising from the body of inquiry in the course of criminal cases. The expert conducting these studies must have knowledge not only in medicine, but also in biology, chemistry, physics and jurisprudence. It is possible to make a forensic medical examination only in the direction of law enforcement agencies.
Necessary
- - Decree on the appointment of a forensic medical examination;
- - passport or identity card;
- - medical documentation.
Instructions
Step 1
When you need to undergo a forensic medical examination, only an investigator or judge can direct you there. Apply to law enforcement agencies. A criminal case will be initiated on its basis. If the investigator to whom he is entrusted is convinced of the actual need for an expert examination, in accordance with Art. 195 of the Criminal Procedure Code of the Russian Federation, he will issue an appropriate resolution on this.
Step 2
In the decision or petition, the investigator will describe the factual grounds that require the appointment and conduct of a forensic medical examination, and indicate the surname, name and patronymic of the expert or the name of the specialized institution that must carry out this examination. With this document in hand, contact the medical institution indicated in it. In addition to him, you will need to present a passport or identity card containing your photograph.
Step 3
In the event that you have already been examined at another medical institution, take medical documents with you confirming this fact. If they remained in the institution where the initial examination was carried out, the representative of the law enforcement agencies must independently deliver them to the expert for research. The study of all available medical documents will make the expert's conclusions more accurate and undeniable.
Step 4
If you, being a victim of illegal actions, ended up in the hospital unconscious, doctors are obliged to immediately notify the law enforcement agencies, which appoint an examination and draw up it with an appropriate resolution. The examination can be carried out right there, in the medical institution where you are. However, the attending physician does not have the right to carry out it - for this, specialists trained to conduct research of this kind are invited.
Step 5
You are legally required to do a forensic medical examination if you get your hands on a court order. The conclusions based on its results must be made by the investigator or the judge who ordered the examination. After passing it, you get a guarantee and confidence that the causes and consequences of the incident that happened to you will be established with a high degree of certainty.
