Disciplinary action is the punishment of an employee who improperly performs work duties. The procedure for the application of punishment is regulated by law. The possibility of imposing a remark, reprimand or dismissal on appropriate grounds is provided exclusively to the employer, about which an order is issued.
Instructions
Step 1
Pay attention to the results of the employee's work during the year after the imposition of the penalty. If the employee does not commit violations, you can independently remove the reprimand or remark from him. An order is issued about this, with which the employee must familiarize himself with signature. In the document, indicate the personal data of the employee, the reason why you decided to early withdraw the disciplinary sanction. Describe in detail the reason for this, here you should make a reference to the regulations. Sign at the bottom, date it and certify it with the official seal.
Step 2
Make sure that the employee reads the order personally and signs it at the bottom of the document. Make several copies, this is not necessary, but may be needed for attaching to a personal file, handing over to an employee, etc.
Step 3
Be aware that an employee who has been exempted from disciplinary action is considered unpunished. You will not be able to subsequently indicate this in the employee review or other documents.
Step 4
Study labor laws. You have the right not to remove the penalty: after a year from the moment the employee was reprimanded or reprimanded, it stops automatically. If during this time you have imposed a new penalty on the employee, then it is added to the old one. The specialist can write a petition for the early removal of the sentence himself or turn to the collective (trade union) for help, if the organization has a collective agreement. The document is drawn up in any order. But it is imperative to put the date and signature under the request and give it to the manager for consideration. The decision to lift a disciplinary sanction or to keep it in force is made individually, and a resolution is raised from below.
