Both the lessee and the lessor have the right to terminate the lease agreement for the land plot - when the term of this agreement expires or ahead of schedule at the request of the lessee or lessor. Termination of a land plot lease agreement is formalized in a separate document (usually an additional agreement). The land plot is returned to the lessor according to the acceptance certificate.

Instructions

Step 1

Any of the parties to the agreement has the right to terminate the lease agreement for the land plot. The contract is terminated when its validity period ends (if the lease was urgent) or ahead of schedule. The conditions for early termination of the lease agreement are spelled out in the Civil Code, however, the parties have the right, at their discretion, to establish in the agreement other conditions under which such an agreement can be terminated.

Step 2

According to the law, the lessor has the right to terminate the lease in the following cases:

1. Failure by the tenant to pay rent more than two times in a row;

2. The tenant's use of a land plot with significant or repeated violations of the terms of the contract (for example, the land plot was provided for growing vegetables, but the tenant set up a landfill on it);

3. Deterioration of the land of the land plot.

Step 3

The lessee also has the right to early terminate the lease in cases where:

1. The land plot turns out to be unsuitable for use for the purpose that was prescribed in the contract;

2. The land plot has drawbacks due to which it cannot be used, while such drawbacks were not previously known to the tenant;

3. The landlord does not provide the land plot for use or creates obstacles in the use of it.

Step 4

If the landlord decides to terminate the land lease agreement with the tenant ahead of schedule, he must notify him in writing about this within a reasonable time. This period is set in the lease agreement.

Step 5

Upon termination of the lease agreement, the lessee returns the land plot to the lessor according to the acceptance certificate. The land plot must be leased in the same condition in which it was accepted. If the tenant has made inseparable improvements to the land (for example, planted trees), and if such improvements have been agreed with the landlord, then the latter must compensate the tenant for these inseparable improvements.
