Receipt of a writ of execution does not mean a real receipt of money. The law regulates the enforcement procedure. There are two ways to collect a writ of execution.
Instructions
Step 1
Submit the sheet to the bank where the account of the legal entity or entrepreneur is opened. To do this, write a statement to the head of the bank, in which indicate:
- the name and details of the claimant, the debtor.
- the debtor's account number.
- the size of the monetary requirements.
- attach the original of the court order.
Send the application in a valuable letter with a list of attachments. The inventory will confirm the loss of the document in order to obtain a duplicate. The bank is obliged to write off funds regardless of the consent of the debtor.
Step 2
Present to the bailiff service at the location of the debtor. Together with the original executive, send a statement on the initiation of enforcement proceedings. Here, indicate: what property can be foreclosed, the requirement to restrict temporary departure from the Russian Federation, your details for which you need to transfer the amount of debt. After the issuance of a decision to initiate enforcement proceedings, the expiration of the term for voluntary execution, it is possible to apply compulsory enforcement measures. This is the sale of the debtor's property, the foreclosure of the debtor's payments (wages, pension).
Step 3
The deadline for fulfilling the requirements in the executive document is two months. After this period, the claimant has the right to apply to the court or the head of the department of bailiffs (chief bailiff) with a complaint about the inaction of the bailiff. If there is no response to the complaint or the failure to take adequate enforcement measures, contact the senior bailiff - the chief bailiff of the constituent entity of the Russian Federation. Next, write a complaint against the chief bailiff to the Federal Bailiff Service via the service's website or by registered mail. Attach all complaints and responses received to your complaint.
