When executing a work contract, violations can arise both on the part of the contractor and on the part of the customer. If you are faced with such a situation, file a complaint with the offender.
Instructions
Step 1
Reread the work contract. Refer also to Chapter 37 of the Civil Code of the Russian Federation. Pay special attention to those norms that are devoted to the regulation of broken relationships.
Step 2
Systematize all violations of the work contract committed by the contractor. Collect written evidence of such violations.
Step 3
Begin to write your claim from the “header”, which is located in the upper right or left corner of the sheet. Enter the details of your counterparty here: last name, first name, patronymic, status of an individual entrepreneur, TIN, address. If an organization is a party to the contract, write the last name, first name and patronymic of the head of the organization, its name, legal address. You should also include your name or the name of your company and its legal address.
Step 4
Below the “caps”, in the middle of the sheet, write the word “Claim”. In the main text, refer to the concluded work contract, indicate its details; Describe the actions or omissions that, in your opinion, violate the contract; provide links to specific clauses of the contract that establish the proper course of action.
Step 5
Support your case by quoting the law. If the actions of the counterparty have caused damage to you, give its justification. Calculate the amount of money you intend to collect. Finally, be clear about your requirements. If there are several requirements, break them down point by point. Be sure to also set a deadline for responding to a complaint.
Step 6
Copies of the written evidence you have of a violation of the work contract and the calculation of the amount to be recovered, if it is cumbersome and drawn up in a separate document, file as an attachment to the claim. You should not attach originals of documents - they may still be useful for you to go to court.
Step 7
Sign the claim. If you represent an organization, certify the signature of its leader with a seal.
