Step 1

A donation is considered the easiest way to transfer a house, apartment, car, etc. to a close relative (for example, a future heir). A big plus of such an agreement is that there is no taxable income on it, that is, the donee will not have to pay tax of 13% of the value of the property donated to him.

Step 2

It is not necessary to sign a notarized agreement between close relatives. A simplified version is enough, that is, a donation agreement concluded in a simple written form. The main thing is to register it with the Rosreestr authorities.

Step 3

In order for the donation procedure to be considered completed, the Registration Service must provide a package of documents: a donation agreement, title documents for property, a certificate of state registration of rights to the donated object, a receipt for payment of state fees, papers for the donated object (cadastral passport, etc..).

Step 4

In addition to the above documents, the Federal Registration Service may require some other documents that must be provided without fail. For example, if you are giving your child a share in an apartment that is part of the joint property of several people who are not your relatives, then their written consent will be required.

Step 5

If the registering authorities do not have any claims to the drawn up contract, then within a month they will register directly the donation contract itself, as well as the donor's right of ownership to the property donated to him. At the appointed time, the donor and the donee, having appeared in person at the registration authority, will receive the documents due to them.

Step 6

And remember, the deed must be drawn up, clearly observing all the requirements enshrined in legislation. Otherwise, the donation agreement may be invalidated.
