In the regulations of Article 112 of the Labor Code of the Russian Federation, holidays in January are 1, 2, 3, 4, 5, 7. Accordingly, working days are reduced. If one of the holidays falls on a Sunday weekend, the number of working days becomes even less. In accordance with Article 112, regardless of the number of holidays in a month, employees receive full pay, depending on the days actually worked.

Instructions

Step 1

If the enterprise cannot stop work or work on a shift schedule, regardless of the schedule, employees must be paid twice for work. If there is no shift schedule, it is possible to engage in work on holidays only with written consent. This is stated in article 153 of the Labor Code of the Russian Federation.

Step 2

For employees who receive a salary, the amount of the salary must be divided by the number of working days in January and multiplied by the number of days actually worked. If an employee has worked all the prescribed days in January, he is supposed to pay the entire salary in full.

Step 3

For those working on a schedule, the salary should be divided by the number of working days in January, multiplied by the number of days worked on holidays and multiplied by two. The rest of the days worked are counted in the usual way.

Step 4

For pieceworkers, the number of holidays in January significantly reduces wages, therefore, in the regulations of Article 112 of the Labor Code of the Russian Federation, the employer is obliged to pay all pieceworkers additional remuneration so that their January salary is equal to the average piecework earnings for the previous year. All additional payments will be attributed to labor costs.

Step 5

If employees are involved in work during the New Year holidays outside of any schedule, and at the request of the employer, it is necessary to obtain not only their written consent, but also issue an order in which to indicate the reason for the withdrawal to work, the full name of the employees, position, date and time of exit and the amount of payment, which will be made for work during the holidays.

Step 6

The TC also provides that, at the request of the employee, an additional day off can be provided for the days of work on holidays.

Step 7

If the employer does not comply with the instructions of all laws, he will face a large administrative fine, and more serious sanctions may also be imposed.
