The usual procedure for registering a newborn child involves the submission of an appropriate application to the registry office by either parent. But what to do when the parents are divorced, when the father is unknown or died before the child is born?

An application for the issuance of a birth certificate is submitted to the registry office within a month from the date of birth of the child. However, there are no penalties for violation of this period. There is no state duty for filing an application. But for the statement on the establishment of paternity, you will have to pay the state fee (in the amount of 350 rubles).

According to general rules, the application is submitted to the registry office at the place of birth of the child or the place of residence of one of his parents.

The registry office draws up a child's birth certificate, in which records are made about the father and mother. An entry about the mother is made at her request, the entry about the father - at the joint application of the parents or by a court decision (in the case when, for example, the former spouses argue about the need to write down the father).

Automatically (without an application) the ex-spouse is recognized as the father of the child if 300 days have not passed after the divorce, and also if 300 days have not passed since the death of the spouse of the child's mother.

When submitting an application for the registration of a child, the mother indicates the name and patronymic of the child, the surname is taken by the mother (if the father is not known). A woman may decide not to record her father at all.

To issue a birth certificate, the following documents are required:

- medical certificate of the birth of the child, which is issued at the hospital upon discharge;

- application for registration of a child;

- applicant's passport;

- a joint statement of the parents on the establishment of paternity (with mutual consent, make a note about the father) and a receipt for payment of the state duty for filing this application.

You can also submit an application for establishing paternity during pregnancy. If the mother does not want to make an entry about the father, he can, with the consent of the guardianship and guardianship authority, apply to the court with demands to establish paternity.
