Step 1
Before visiting, the bailiffs are required to send you a decree, which will indicate the due date of the debt. For the time remaining before the foreclosure, you can pay off the creditor or file an application with the court for a deferred payment or payment by installments. If you follow the payment schedule, the claimants will no longer bother you.
Step 2
If, after the expiration of the specified period, the debt has not been paid and the installment plan has not been issued, wait for the visit of the bailiffs. First of all, check their credentials and the existence of a foreclosure order. The bailiffs do not come on personal initiative. Their visit is a consequence of the court hearing. Keep in mind that all kinds of collection agencies have nothing to do with the public service of bailiffs.
Step 3
According to the Federal Law "On Enforcement Proceedings", the bailiffs have the right to visit in the interval from 6 to 22 hours. For people who appear at night, you have every right not to open the door.
Step 4
Be polite - the bailiffs are just doing their job. They usually behave quite correctly. However, if it seems to you that the representatives of the law are speaking in an inappropriate tone, you can calmly point them to this or complain about them in writing to your immediate superiors.
Step 5
Do not try to hide from the bailiffs or ignore their arrival without opening the door. A debtor not found at the place of residence may be put on the wanted list. With the written permission of the chief bailiff, it is possible to open the door - it is better not to bring it up to this.
Step 6
If there is property in the apartment that does not belong to you, prepare in advance the documents proving this - a warranty card for the equipment, a signed check or a loan agreement in the name of the owner. The bailiffs cannot seize your personal belongings and essentials. Usually they are interested in household appliances, computers and, of course, a car.
Step 7
At the seizure of property, attesting witnesses, for example, neighbors, must be present. Their absence is a gross violation of the law, as a result of which the actions of the bailiffs can be appealed in court. The relatives of the debtor, claimants or creditors cannot act as witnesses.
