The responsibility of the school for the safety of students in class and recess is clearly set out in the Education Act. At the lesson, the teacher is responsible for the children, leading the lesson, at recess - the teacher on duty. However, the general responsibility for everything that happens in the educational institution bears the head.
Responsibility for the life and health of students during their stay within the walls of the school, regardless of whether it is a lesson or a change, is borne by the educational institution in the person of the school principal. According to the law "On Education" (Art. 32), all claims of parents about the child's injury received during recess must be directed to the head.
Organization of student safety at school
The school administration is obliged to create such conditions for learning that will ensure the safety of schoolchildren's stay in the educational institution. Although PE and technology lessons are considered the most traumatic, most of the ills happen in between lessons, when students are on their own.
Primary school teachers are more vigilant during recess and try not to leave their pupils unnecessarily. In model schools, counselors are encouraged to participate in providing organized recreation for children. However, the minor counselor does not bear any responsibility if an injury occurs during the games, so the presence of a teacher is also mandatory in this case.
In middle and high school in the conditions of the cabinet system, students should move from office to office during recess. In this case, each subject teacher remains in his class and prepares the room for the next lesson. Naturally, he is not able to keep order in the corridor, unless his attention is attracted by a loud noise outside the door. At this time, the teacher on duty is responsible for order. Typically, in large multi-storey schools, there will be on-duty teachers on each floor. After all, one accompanying class on duty will not be able to keep track of everything that happens at the school.
Who's guilty?
If a child is injured during recess, parents can contact the school principal with a statement. True, before that, it is necessary to record the fact of an accident in a medical institution. This is especially important if the injury is serious and will require financial recovery from the guilty person for treatment. Sometimes parents do not even think about going to court in order to receive financial compensation. They are more worried about the very circumstances of the incident, understanding which it will be possible to avoid re-traumatizing other children.
If the injury is received during a fight between students, then the instigator will still not incur any serious punishment other than educational influence from adults. The teacher on duty, who did not stop the fight in time, will be to blame. For each individual accident, in response to the parents' statement, the school administration is obliged to conduct an investigation. If, as a result, the guilt of the teacher on duty, who was simply absent from his site or did not respond properly to the students' behavior, is revealed, then a disciplinary sanction will be imposed on him. However, the head of the school still has to answer for everything that happened to the parents.
