Upon termination of the employment contract, each employee must receive compensation for those vacation days that he did not use. This condition is spelled out in Article 127 of the Labor Agreement of the Russian Federation. But in order to determine the amount of the payment, you must first calculate it.
Instructions
Step 1
For each year worked, the employee is entitled to at least 28 calendar days of vacation. This number can be increased if the workplace is located in the Far North or equivalent areas. Additional leave is also granted to those employees who work in hazardous and harmful working conditions. It follows from this that for each month of work the employee is provided with 2.33 days of vacation (28 days / 12 months).
Step 2
The compensation is calculated based on the average daily wage. For the calculation, the average number of days in a month is taken - 29, 4. First of all, add up all the payments that were accrued to the employee for the hours worked. Divide the resulting number by 12 months (if the year has been fully worked out) and by the indicator 29, 4.
Step 3
The resulting number will be the average daily wage. Now multiply this indicator by the number of vacation days that the employee did not use. The amount received must be paid to the employee as compensation upon dismissal.
Step 4
When calculating the length of service, keep in mind that the days when the employee was on leave without pay can be included in the length of service only if their number does not exceed 14 days.
Step 5
If the employee has not completed a full month, round up the figure. That is, if, according to the time sheet, he was actually present at work for 14 days, the month is excluded from the length of service.
Step 6
Pay the amount of compensation on the day of dismissal. In the event that the employee was absent from work that day, pay off with him when he comes for a work book.
Step 7
When calculating vacation days, keep in mind the fact that you can only round up the indicator. That is, if, according to the calculations, he is entitled to 17, 3 days of vacation, take this number for 18 days.
