The daily work process at an enterprise or in an organization is subject to the rules of the internal labor schedule. This document is developed by the management on the basis of the Labor Code and taking into account the characteristics of the team. Usually, the internal regulations indicate the mechanism of admission to work and dismissal, the time of the beginning and end of the working day, lunchtime hours, etc. The rules can be approved only after agreement with representatives of the organization's labor collective.
Instructions
Step 1
Develop a draft of the internal labor regulations. The project will be based on the Labor Code of the Russian Federation, especially Section VIII “Labor Regulations. Discipline of Labor ". In it you will find a definition of the concept of "internal labor regulations", the approximate structure of this document and the requirements of the law for the procedure for its approval.
Step 2
Submit the draft internal labor regulations to the representative body of the organization's labor collective for consideration and approval. The representative body can be a trade union committee, a workforce council, or individual representatives elected by a majority of employees. If there is no such body, the document can be agreed upon at the general meeting by voting.
Step 3
Examine the objections, additions and comments of the representatives of the collective. Employees must express their disagreement in writing five working days after receiving the draft internal labor regulations.
Step 4
Schedule additional discussion of controversial items in the project. This must be done within three days after receiving written comments from the labor collective. Invite members of the representative body, lawyers, and the most authoritative employees to the discussion. Try to settle your claims through negotiations.
Step 5
Draw up a protocol of disagreements in the event that it was not possible to reach an agreement that meets the interests of both parties. In the protocol, indicate the original version of the controversial paragraph of the internal labor regulations, the proposals of the team and your arguments against it. The law gives the employer the right to approve the draft rules even when agreement is not reached on all of its points.
Step 6
Remember that representatives of the work collective have the right to appeal the approved internal labor regulations to a higher authority, for example, in the state labor inspectorate or in court. In addition, employees have the right to organize a collective labor dispute in accordance with the provisions of the Labor Code. Therefore, when preparing the draft rules, take into account the interests of the team as fully as possible and do not deviate from the norms of the current legislation.
