Step 1
Contact the labor dispute committee, which is usually organized in large enterprises and in serious companies. If your company does not have such a body, you can create one. It may include authorized representatives of the employer and the work collective. Step 2
Write a grievance against the employer, detailing all of your grievances and requirements. Give the signed document to the commission and wait for its decision. It should be borne in mind that some issues cannot be resolved with the participation of this body, in particular, some individual labor disputes.
Step 3
Refer your complaint to the territorial office of the labor inspectorate. This institution performs a supervisory function in the area of compliance with Russian legislation. In order for your complaint to be considered, it is necessary to supplement it with specific facts of violations, supporting documents and other evidence. The consideration of the complaint in this body is usually carried out within a month, after which, when the dispute is resolved in your favor, the employer will receive a notification with the requirements for elimination of violations.
Step 4
Try to resolve the arisen conflict in court. Be clear about your claims and requirements. In order for the court to accept the application for consideration, it must appear to be certain issues specified in the Labor Code of the Russian Federation, for example, failure to fulfill the obligation to pay wages within three months, refusal to take paid leave, etc.
Step 5
Submit supporting documents to the court in the form of a copy of a work book and an employment contract, as well as orders and orders of the employer that are valuable for the case, pay slips and other documents. To expedite your case, you may want to involve members of your trade union or labor dispute committee as your legal representative.
