Instructions

Step 1

Many gardeners were encouraged by the example of summer residents of the Krasnodar Territory, who were able to prove in court their constitutional right to free movement and choice of place of registration. However, this is not an easy matter.

Step 2

According to the requirements of the Constitution, a Russian citizen can only be registered in a residential building. Accordingly, in order to register at a summer cottage, you need to prove that the cottage is a residential building. This is the most difficult moment, because the requirements for living space are very strict.

Step 3

The dacha must be located on the territory of the settlement. The structure must have a foundation and walls built in accordance with all safety standards. The premises are considered residential, provided that all communications are available. There must be electricity, drinking water, heating and sewerage systems. The presence of individual heating and sewerage systems is allowed, but they must be made in accordance with the norms of SNiP and SanPiN.

Step 4

It is quite difficult to fulfill all the conditions, especially many claims arise about compliance with SNiPs. It is necessary to make a construction expertise, which will prove that the house is suitable for year-round living.

Step 5

Having received a positive result of the examination, apply to the court with the following documents: documents confirming the ownership of land and a house, technical passport of the BTI, the result of a construction examination, a receipt for payment of the state duty. If the court makes a decision on recognizing the dacha building as a residential building, contact the territorial body of the FMS to obtain registration at the dacha plot. Keep in mind that the deadlines for obtaining such registration are not indicated anywhere, so the process can be delayed for a long time.
