The employee is obliged to notify the employer that he is going to resign at least 14 days before leaving. An employee can either work or spend this period on vacation if he has unused days left.
Instructions
Step 1
Determine how many days of off-season vacation you have left. By law, an employee is given 28 calendar days per year, or 2.33 days for each month worked. At the same time, the employer is obliged to provide the employee with the first rest 6 months after employment. Calculate how much time you work and how many vacation days you are entitled to during this period. Subtract the vacation you used to find out how many days you have left. If there are less than 14 of them, then you need to notify the employer about the termination of cooperation before you go on vacation. Otherwise, you will have to work the remaining days if your supervisors require it.
Step 2
The Labor Code obliges the employee to inform the employer of his / her leaving at least 2 weeks in advance, however, by agreement of the parties, the employee may quit earlier. For example, if an employee has 8 days of vacation left and the employee notifies his management about leaving on the day before the vacation, then the management has the right to require the employee to work for 6 more days after the vacation. But if the employer does not insist on this, the employee may be fired on the last day of vacation. It is convenient to submit 2 applications at once: for vacation and for dismissal.
Step 3
The employer has the right not to send you on vacation if it is not provided for by the vacation schedule drawn up for the current calendar year. In this case, you will have to work for 2 weeks, if the bosses require it. Upon termination, you will receive monetary compensation for unused vacation days. If you walk all the allotted time, you will not be reimbursed. You also have the right to use part of the remaining vacation, and for the rest of the days receive monetary compensation upon dismissal.
Step 4
The last working day will be the last day of your rest. This date will be in your work book. However, you can pick up the document on the day before the start of the vacation. At the same time, you are required to issue a certificate of the calculation of insurance premiums for the last 2 calendar years. You will need it at your new place of work for the calculation of sick leave and benefits.
Step 5
Starting from the second year of employment, leave for the current calendar year can be granted in advance for the entire year. Therefore, a situation may arise when you not only have no unused days of rest, but you actually owe them to the employer. Then the excess accrued vacation pay will be deducted from your last paycheck.
