A variety of motives can be hidden behind the wording "of their own accord": moving to another city, family problems, dissatisfaction with wages, change of profession, etc. The law gives the employee the right not to indicate a specific reason for terminating an employment contract. But all other stages of the dismissal procedure must go through openly and in a strictly established manner.

Step 1

Study the Labor Code. The process of dismissal of one's own free will is regulated by article 80 "Termination of an employment contract at the initiative of an employee". From the point of view of the law, the ideal option for terminating the employment relationship includes: a written notification to the employer, the employee's work for two weeks after the application is submitted, termination of the contract on the last working day and the issuance of a work book and full cash settlement.

Step 2

Talk to your supervisor prior to applying. The conversation can be difficult and unpleasant, but once it has taken place, it will clarify positions and determine your next steps. If possible, explain to your boss the reason for the dismissal, if not, just say that you have made the final decision.

Step 3

Check if you need to work exactly 14 days or if the working period can be shortened. The law leaves this decision to the discretion of the employer. Perhaps your boss will oblige you to work only 2-3 days to complete the project. But if it is more convenient for you to work out the legal two weeks, warn about it. The manager is obliged to respect your rights.

Step 4

Write a letter of resignation. There is no single form for it. You can ask for a sample in the HR department. The application is written in the name of the head of the organization. The wording most often sounds like this: "I ask you to dismiss me from my post of my own free will from 01.01.2012." Then the date of writing the application and the personal signature of the employee are put.

Step 5

The date of dismissal in the application means the last working day. Put in the day and month that you agreed with the manager. If there is a disagreement between you, count down the 14 days prescribed by law. You need to count from the day following the day of filing the application. Write this date in the application. The employer has no right to detain you any longer.

Step 6

Work the remaining days before you leave your job in good faith. Complete projects that have started or pause them. Prepare business files for transfer to another employee. Find out who of your colleagues will take over your duties, talk to them and tell them about the most urgent tasks. Introduce your partners and customers to the person who replaced you. Clean up computer folders, delete personal documents and correspondence. Empty your desk drawers, take home souvenirs and personalized rewards.

Step 7

On the last working day, read the entry in the work book. Pay attention to the correct date of dismissal and its grounds. In the record of the personnel department, only article 80 of the Labor Code of the Russian Federation should be indicated. Get your work book in hand.

Step 8

On the same day, the accounting department of the organization must make a full calculation of the funds owed to you. They will be issued in cash or transferred to a bank card. The calculation takes into account the salary for the last month of work, funds for unused vacation days, bonuses, financial assistance and other payments provided by the company.
