Any service provided to the population must be reflected in a competently drawn up civil law contract. This will protect you from financial risks and help to avoid poor quality service performance.
Instructions
Step 1
Starting to draw up a contract, decide on the object, that is, the provision of which service will be regulated by this document. Separately write down your goals as a customer (for example, the construction of a summer greenhouse in a summer cottage of a certain area and from a certain material within three calendar days) and the goals of the contractor (obtaining financial benefits). First draw up the contract itself on a draft, making edits to it as it is written and agreed between the parties.
Step 2
Divide the contract into several parts conditionally:
- preamble, where indicate the full and short names of the parties, the date and place of signing the agreement;
- the subject of the agreement - the provision of what service the contract concerns, what needs to be done on it, as well as the deadline for fulfilling the obligations of both parties;
- responsibility of the parties for non-fulfillment of obligations, poor-quality fulfillment, and other actions;
- how the arisen disputes will be resolved;
- details of the parties - address, individual taxpayer number, bank account.
Step 3
Describe clearly what the contractor should do, from what material, in what time frame. Indicate whether you have the right to control the work process until its completion, how the work acceptance process will proceed. It is important to indicate whose material will be used in the production of work, if it is a construction or repair. Does the contractor give a guarantee.
Step 4
Especially accurately write down the responsibilities of both parties. What awaits the contractor if he performs the work poorly or does not have time to do it on time, what is the responsibility of the customer in case of late payment of the contract. Check all numbers and data several times. Write how disputes will be resolved if they arise - through a court, through an intermediary, or during a personal meeting between the customer and the contractor.
Step 5
In the details, indicate the bank account to which payment for the work performed should be made.
Step 6
Before signing a contract, check whether a person has the right to conclude contracts, sign documents, whether he has a power of attorney.
