The right to receive a free land plot is provided for by the legislation of the Russian Federation. But not everyone can exercise this right.

According to paragraph 2 of Art. 28 of the Land Code of the Russian Federation, large families are endowed with the right to receive a land plot free of charge. However, the legislation imposes a number of requirements that a family must meet:

  1. At least three minor children. The exception is children enrolled in full-time education in educational institutions and those who are in military service. In this case, the age range is increased to 23 years. Children include not only relatives, but also adopted children.
  2. All members of a large family must have the same registration and live at the same address for at least 5 years.
  3. All family members must be citizens of the Russian Federation.
  4. Neither an apartment, nor a house, nor any other land plot should be owned.
  5. None of the spouses was deprived of parental rights.
  6. The need for a land plot has been documented by special authorities.

If all the conditions are met, a large family can collect documents and submit them for consideration to the municipal authority, which, in turn, is obliged to consider the application and give an answer within 30 days.

The package of documents should include:

  • copies of passports of parents and children who have it;
  • birth certificates of all children;
  • a copy of the marriage certificate of the spouses;
  • a document confirming the same residence permit for all family members for at least 5 years;
  • a certificate from the guardianship and guardianship authorities that none of the spouses was deprived of parental rights;
  • certificate stating that children are not fully supported by the state;
  • documents confirming the lack of ownership of any housing and land;
  • the conclusion that the family really needs to improve their living conditions.

All of the above documents must be notarized, after which the package is sent for consideration to local authorities in the committee on the use of municipal lands. In the application, it is also important to indicate where the family would like to receive the land plot, but within the municipal district. According to the law, no more than 30 days are allocated for consideration of the application.

If the answer turns out to be positive, then within a year a large family receives a land plot for targeted use. It is worth knowing that having received a free land plot, the family is automatically removed from the queue for an apartment, if any.

In the event of a refusal, the municipal authority must indicate the reason why the application was rejected. Then the family can either appeal the decision in court or apply again.
