It is quite possible to divide one land plot into two if the newly formed plots correspond to the minimum area established in the region. For the section, you will have to carry out a repeated land-surveying procedure, put two different plots on cadastral records and re-register ownership of the newly formed plots.
It is necessary
- - application to the cadastral chamber;
- - technical documents;
- - cadastral extracts;
- - application to the registration chamber;
- - two receipts for payment for registration;
- - passport;
- - certificate of ownership.
Instructions
Step 1
If you are the sole owner of a land plot and plan to divide it into two plots, one of which can later be sold, donated, exchanged, or otherwise legally significant actions that do not contradict current legislation, contact the local administration and find out what is the minimum area of land plots installed in your area. If the newly formed plots correspond to this area, then you, without any problems, have the right to carry out the procedure for re-surveying, establish the boundaries of two plots, put them on a single cadastral register and register ownership of two separate land plots.
Step 2
If a single land plot has several owners, you are obliged to agree on the section with all the owners or file a claim with the court for a compulsory section.
Step 3
To carry out re-surveying, contact the cadastral chamber, call the cadastral engineer, who will conduct the entire list of necessary technical work for the section of a single allotment.
Step 4
Submit the received technical documents to the cadastral chamber. Submit an application, present a certificate of ownership for a single allotment. On the basis of the submitted documents, your two allotments will be put on a single cadastral register, assigned different cadastral numbers and issued a cadastral passport, an extract from which you need to get in order to carry out the procedure for registering ownership of the newly formed land plots.
Step 5
To register ownership of two different land plots formed from a single allotment, contact the registration chamber. Present your passport, certificate of ownership for a single plot, cadastral extracts for both newly formed plots, fill out an application, pay double the state fee, since registration of property rights will be carried out on two different plots.
Step 6
After one month, you will be given two title deeds.
