Step 1
Contact a lawyer or attorney who is appealing the disqualification immediately after the court is sentenced. Remember that ordinary legal advice without the involvement of a lawyer can be useless, since an appeal requires in-depth knowledge of the legislation of the Russian Federation and the procedure for conducting a judicial investigation. Also, the appeal of deprivation of rights is not in all cases promising, and only a highly qualified lawyer, after studying your case, will be able to determine whether you will win the case or not.
Step 2
Write an application to the court to hand your case into your hands (take a sample of writing such applications in court, from a lawyer, or download it from the Internet). Make photocopies of all pages of the case, including the order issued to you, and give these documents to a lawyer for examination. If a lawyer advises you to appeal the deprivation of rights, make a complaint with him and within 10 days from the day you receive or receive the court order, file it either with the court that issued the order or with a higher court.
Step 3
If you do not have time to file a complaint within 10 days from the date you served or received the order, appeal the decision made by the court to the supervisory instance. To do this, your lawyer must prepare a document of the appropriate sample and indicate in it the presence of procedural errors in the case. If the supervisory authority agrees with the illegality of the court's verdict, your rights will be returned to you. Do not forget that during the consideration of the case by the supervisory instance, you are deprived of the right to drive vehicles until the relevant decision is made, and a temporary permit to drive a vehicle is not issued or extended. Also, the period for which you were deprived of the right to drive the vehicle is not suspended during the additional investigation.
