Additional leave can be granted to any employee if it is specified in the collective agreement, and is guaranteed by law to persons working in harmful and dangerous conditions (article 117 of the Labor Code of the Russian Federation), with irregular days (article 119 of the Labor Code of the Russian Federation) and in the regions of the Far North (article 287 and 321 of the Labor Code of the Russian Federation).

Instructions

Step 1

Calculate additional leave based on the length of time an employee has worked in special, difficult, harmful or hazardous conditions. To do this, subtract the date of hiring from the date the employee goes on vacation. Divide the resulting number by 12 and multiply by 1. That is, for each year of work, one additional day of vacation is allowed, unless otherwise specified in the collective agreement or other internal acts of the enterprise.

Step 2

Provide additional leave together with the annual main leave, unless the employee has expressed a written desire to split the leave into several parts or to postpone the additional leave to another time.

Step 3

Employees who have Chernobyl status are paid additional leave by the FSS and this leave is regulated by the Federal Law. You are required to provide the required additional days and issue a certificate of wages for presentation to the FSS.

Step 4

When calculating additional leave for each year of work in harmful, dangerous or special conditions, keep in mind that the additional leave guaranteed by law has restrictions, while the leave established by internal acts or contracts is not limited and depends on the employer's capabilities.

Step 5

If you calculate the vacation for senior civil service officials, then the additional vacation in general terms cannot exceed 45 calendar days. For the middle management - 40 calendar days, based on the main leave of 28 calendar days plus the number of days of the prescribed extended leave.

Step 6

Pay for any vacation based on the average daily earnings for 12 months. To do this, add up all the amounts earned from which income tax was withheld, divide by 12 and by 29.6. Multiply the resulting figure by the number of vacation days, subtract 13%. The original number will be the vacation pay.
