The Labor Code of Russia states: a business trip is a trip of an employee to carry out an employer's assignment for a certain time to a place remote from where he constantly works.
The employee's permanent place of work is indicated in the employment contract. A business trip will be considered a business trip if the employee has been given a specific assignment, which is recorded in the service assignment. There is a special unified form of such a task - No. T-10a, approved by the State Statistics Committee of Russia. The assignment is always attached to the travel certificate.
Does not apply to business trips: business trips of train conductors, flight attendants and other employees who either have permanent work associated with traveling or they work on a rotational basis.
And, on the contrary, business trips are, for example, a trip of an employee of the head organization on the instructions of the employer to a separate unit (branch) and, conversely, a trip of an employee of a branch to the central administration.
In addition, business travel includes travel when homeworkers (teleworkers) visit the employer's location. Moreover, the employer must reimburse such employees for all expenses related to the business trip, including paying for accommodation.
But a trip to which a person working under a civil law contract is sent is not a business trip, because only an employee registered in accordance with the Labor Code of the Russian Federation can be sent.
Thus, the main signs of a business trip are the executed order of the employer and the job assignment.
