If a person lives in Ukraine in an apartment that is not privatized, he can be discharged at the end of the lease agreement, as well as for violation of its terms. If a person was registered in the apartment at the time of its privatization, it is impossible to evict him even by a court decision.
Instructions
Step 1
Enter into a rental or lease agreement with the person who lives in your non-privatized apartment. It must be drawn up in accordance with all the rules. Certify the contract at a notary office. It is imperative that you keep your copy of the rental agreement. Keep in mind that you have the right to terminate this agreement early and unilaterally. To dismiss a person living on such conditions in your apartment, you need to come up with a rental agreement to your housing department. Due to violations of the terms of this agreement, it is possible to cancel registration. If your claim is not satisfied, go to court.
Step 2
Provide evidence of breach of contract required by the court. This is the only way the court can rule that a person cannot be registered on your living space and take your side. Prepare the documents that are required to start the trial. Such documents include an act confirming the fact that a person has not lived in your apartment for more than six months, and unpaid apartment bills. The act must be drawn up by employees of the housing department. In addition, this document must be signed by two witnesses. In addition to the above documents, you must provide the court with evidence that the person you want to discharge has the option of living in another living space.
Step 3
Contact law enforcement agencies to discharge a person who lives at the place of registration, pays for utilities, but does not comply with the rules of residence. Write a statement asking that the person be held accountable. With evidence and a certificate confirming the unsatisfactory behavior of a person, go to court.
