The transfer to a management company of the same enterprise is voluntarily carried out in accordance with the Labor Code of the Russian Federation. If the transfer is not carried out to an elective position, then it can be processed in the usual way. If the transition takes place to an elective position, then according to the law it should be carried out by dismissal and new employment.

Step 1

If an employee is transferred of his own free will, then he is obliged to submit an application. When transferring within the same company, processing is not carried out. But if an employee wants to get another vacation before going to work in a management company, then you must provide it.

Step 2

Issue a transfer order, indicate the reason for the transfer, date. If you have provided another vacation, then write that the transfer is carried out after using the next vacation.

Step 3

Make an entry in the work book about the transfer. The date of the transfer of your own free will be entered in accordance with the date specified in the order.

Step 4

If you transfer an employee to a management company on your own initiative, notify him in writing two months before the transfer.

Step 5

Issue an order when the notice expires. Record the transfer in the work book and the employee's personal card. Responsible representatives of the personnel department of the management company will draw up an additional agreement to the employment contract.

Step 6

If an employee wants to use all the days of the next vacation and only after that start working in the management company, then you must provide him with the opportunity to exercise this right.

Step 7

If an employee from your structural unit is elected to a managerial position, then you are required to follow the usual procedure for dismissal (article 84.1 of the Labor Code of the Russian Federation).

Step 8

Upon dismissal, issue a full calculation (article 140 of the Labor Code of the Russian Federation) and compensate for all days of unused vacation (article 127 of the Labor Code of the Russian Federation).

Step 9

Employment will be formalized by the responsible representative of the management company within the framework of Article 68 of the Labor Code of the Russian Federation. The procedure for admission to an elective position is no different from ordinary employment.

Step 10

The elected leader is obliged to present a work book, a document on education, an identity document, and other documents provided for by the specifics of the work. Each time an employee is re-elected for an additional term, the powers are extended by dismissal and new employment.
