It must be admitted that the need for redevelopment arises very often, be it an office, apartment or house. However, it is impossible to arbitrarily make changes to the structure of the premises - this is punishable by law. Anything you want to change must be agreed with the authorities. But often the need to complete all the necessary documents appears after the fact, when the repair has already been done. How to act in this case?

Step 1

There are two ways to solve the problem of unauthorized redevelopment: administratively and by court, moreover, practice shows that most of these issues are solved in the second way. Therefore, this article deals with the judicial path.

Step 2

First, you need to understand which of the two methods will be applied in your case during the legalization procedure. To do this, you need to seek advice from the body that coordinates the redevelopment.

Step 3

Then you need to prepare the following documents: the old technical passport of the premises, a document confirming the ownership of the premises, an application for a new technical passport and the written consent of all owners. All these documents must be taken to the BTI, so that there you will be given a new technical passport. An employee will come to you from the BTI to record the changes that you have made.

Step 4

In addition, you need to obtain a conclusion from the Sanitary and Epidemiological Station (SES) that the premises do not violate any standards. To confirm this, an inspection by a SES employee will be carried out. If everything is in order, you will be given a certificate (but you will have to wait until it is issued).

Step 5

You go to a design organization that has an appropriate license and order a technical project of the premises. Then you file an application to the court to legitimize the unauthorized redevelopment. Along with the application, one more package of documents must be submitted: the conclusion of the SES, the old and new technical passports, the certificate of ownership (original or notarized copy), the conclusion from the design organization.

Step 6

If the court made a positive decision, you can go to receive a new cadastral passport. A new certificate of state registration of the right to the premises must be obtained if the size of the living space has changed.
