What is the number of days of unused vacation? This is the period for which the employee subject to dismissal is paid monetary compensation. Count the number of full months and days you have been with the organization. Start with the very first and end with the day of the layoff. When calculating, do not take absenteeism into account. It is important to take into account that the amount of time worked that did not make up a full month is rounded up to a month if it has 15 days. Let's say an employee has worked for 9 months and 18 days. This means that the compensation will be paid in 10 months. The amount of days for unused vacation is calculated using the formula: 28/12 x 10 = 23, 33, where 10 is the number indicating the months worked for the billing period, 12 is the number of months according to the calendar, 28 is the number of calendar working days per month.

If an employee has worked in this organization for 11 full months (excluding the month of vacation), counted as length of service, which gives the right to vacation, then the employee is entitled to receive full compensation for unused vacation.

If an employee has worked in this organization for less than six months, then, in accordance with the text of the Rostrud letter of 23.06.2006 N 944-6, this employee receives compensation for unused vacation in the prescribed manner. In this case, the number of days of unused vacation is calculated using the above formula (step 2).
