Instructions

Step 1

In the event that you do not have minor children, the procedure for divorce is carried out in the Civil Registry Office (if the spouses have no property claims). To do this, you need to present a passport, marriage certificate and pay a state fee. Of course, you will be given a 3-month period for reconciliation. But the divorce procedure can be accelerated due to various circumstances (for example, if the husband / wife has drug addiction).

Step 2

If you have minor children and / or property claims against your spouse, you need to submit a statement of claim to the court (signed by the plaintiff) in 2 copies. In addition, you will need a marriage certificate, a certified copy of the child's birth certificate, a certificate of family composition, information about property. When registering an application with the secretary, you will need to present your passport.

Step 3

Within the framework of one litigation, it is possible to combine both the divorce case and the case on the division of property and the award of alimony to one of the parties. But it is better to single out the case of the order of meetings with the child in a separate process, since this can drag out the hearings for a long time.

Step 4

If you want to file for divorce, but you do not know where your spouse is currently living, as an exception, you can apply to the court at your place of residence or at the place of previous registration of your spouse. The judgment can also be made in absentia.

Step 5

If your spouse is in another city and is in no hurry to divorce you, apply to the court. With the proper organization of the correspondence process, the marriage will be dissolved.

Step 6

In the event that your wife is pregnant, or has recently given birth, you cannot file for divorce until the child is one year old. But the wife has such a right.
