Extortion (called in other words "racketeering") is a criminally punishable act expressed in the demand of the extortionist to transfer to him someone else's property and accompanied by violence or the threat of its use against the victim, damage or destruction of his property, as well as the threat of disclosing information that the victim or his relatives relatives wish to keep it secret. Very often, the objective side of extortion is limited only to an oral conversation between the offender and the victim, during which the attacker formulates his demands. For this reason, it is difficult to collect the evidence base, and especially material evidence, which can greatly help the investigating authorities in solving the crime.
Instructions
Step 1
After the extortionist demanded to give him your property, for example, a certain amount of money, do not be discouraged and tell him that you do not have the required amount with you and you will give it back later. Do your best to ensure that the transfer of property does not take place immediately after the announcement of the attacker's demand, otherwise it will be very difficult for you to prove the fact of extortion.
Step 2
Go to the police station, the investigative committee, or the prosecutor's office. These are the bodies that have the right to initiate criminal cases.
Step 3
Write a statement that illegal actions have been committed against you, namely: the requirement to transfer property, as well as violence or the threat of its use. If you are beaten, request that law enforcement officials arrange for a health worker to be screened for bodily harm.
Step 4
When your application is considered and the investigator initiates a criminal case, the stage of operational search activities and investigative actions will begin, in which you will take an active part.
Step 5
Agree with law enforcement officers about the place and time of the meeting with the extortionist. Receive from them specially marked banknotes or other property extorted from you, technical means of audio and video recording.
Step 6
Come to the meeting place and transfer the property claimed by him to the attacker. During the conversation, behave naturally, do not give out your excitement if you have it. The extortionist may notice this and, realizing that his illegal activities have been disclosed, commit violence against you. Be calm and confident that everything will be fine with you.
Step 7
In the future, the officers of the investigating authorities will arrest the attacker, search, find the marked property on him, seize and attach this property as evidence in a criminal case. Audio and video recording of your meeting, executed in a procedural manner, will be another weighty argument in your favor.
Step 8
After the completion of the investigation, the criminal case will be referred to the court. During the trial, the judge will assess the collected evidence in terms of relevance, admissibility and reliability. If all the evidence is drawn up in accordance with the legal norms of the criminal procedure legislation and does not raise doubts among the judge, then be sure that your offender will be convicted and punished to the fullest extent of the law.
