The homeowners' association is created by the owners of premises in houses included in the "multi-apartment" category. So you will start joint management of all real estate in the house along with the land plot, residential building and other objects. The decision made during the general meeting and determining the method of management necessarily applies to all owners in the house.
When starting to register a partnership, submit the documents no later than within 3 months from the day when the apartment owners made a decision to create an HOA. Prepare a statement in the package of documents, which must be signed by an authorized person. The application must be with the indication of the last name, first name, patronymic, place of residence and contact phone number of the person performing the function of the authorized person. Print in triplicate and attach the charter. Prepare in duplicate the decision on the establishment of the owners' partnership.
Make two copies of the bylaws approval decision. When approving the charter, you must indicate the composition of the elected bodies. Make two copies of the document that provides information about the founders. Pay the state fee and add a receipt of payment to the package of documents. Separately indicate the address of the current HOA body so that the registration service can contact him.
In the event that you are the owner of an apartment, you must be invited to vote. According to the Housing Code of the Russian Federation, the decision to create a partnership of owners is considered only if more than half of all owners of premises in an apartment building voted for it. Be careful, because it is impossible to count votes by the number of apartments or rooms during absentee voting. The number of all votes must be equal to the number of all apartment owners.
If voting is carried out in absentia, then it must be formalized by personal written decisions of the owners. In each decision, include details of the individual voting. Enter information about the document on the basis of which the ownership of the apartment is confirmed. Then indicate a specific decision on the question “for” or “against”, or “abstained”. Your documents on the establishment of a homeowners association are accepted by the Rosregistration department. Then they will undergo an examination. If the examination reveals facts of violation of the law, contradictions in the constituent documents, then you will be denied registration.
