Dacha associations are a voluntary association of citizens, which each participant has the right to leave. There is no exact procedure for leaving garden partnerships. In each case, the terms of withdrawal are agreed with the governing body of the partnership, based on the current legislation.
Instructions
Step 1
Carefully study the charter of the organization, which should spell out the procedure for the withdrawal of members from it before taking the first steps. Then, in the manner prescribed by the charter, write an appropriate statement (take a sample of such statements from the chairman of the partnership or download it from the Internet), register it and submit the document for consideration to the chairman. After making a decision on your issue, conclude an agreement with a gardening partnership on the procedure for the use and operation of public property (if any), engineering networks and roads. Be sure to keep copies of all documents.
Step 2
Write a statement of withdrawal from the garden partnership, if the organization's charter does not spell out the procedure for withdrawing from it. Register your application and wait for the relevant order to be issued within the period provided by the legislation of the Russian Federation. After that, conclude an agreement on the procedure for the use of utilities, roads and existing public property. Go to court if disputes or disagreements arise.
Step 3
Receive, in accordance with the procedure established by the Law of the Russian Federation, a part of the public property transferred to the partnership by its members, or an equivalent amount to this property, unless otherwise provided by the charter of the organization in the event that the garden partnership is a non-profit partnership. To do this, write a corresponding statement to the chairman of the gardening partnership, register the document and await the issuance of a resolution. If you cannot resolve the issue with the chairman of the partnership, go to court with a corresponding statement. You will not be able to return the membership fees made during your stay in the gardening partnership, since this money is considered an operating expense and is not refundable.
